Terms of Service

ENL Marketing provides digital marketing services — Meta advertising - Facebook and Instagram — to independent US medspas and aesthetic clinics. The specific services to be provided to you will be set out in a separate proposal or statement of work before any work begins. Nothing on this website is a binding offer.

You pay a monthly management fee, the amount of which is agreed in writing before we start. Fees are invoiced monthly in advance and are due within seven days of the invoice date. Late payment may result in the pausing of your campaigns until the balance is settled.

Advertising spend is paid by you, the client, directly to the advertising platform from your own ad account. We never mark up your spend, and we never hold your budget. You retain full control of your ad account at all times.

We run Meta advertising and we follow up the enquiries it produces. We do not manage your social media accounts and we do not post organic content for you. We do not manage, solicit or respond to your online reviews. We do not provide reputation management. We do not run advertising on Google, TikTok or any platform other than Meta unless we agree that separately in writing.

We work with one clinic per ZIP code. If we are already working with a clinic in your ZIP code when you inquire, we will tell you and we will not take you on. This exclusivity applies for the duration of our engagement and is mutual: we will not approach a competing local clinic while we work with you.

Our engagement runs for an initial term of ninety days. After that it continues month to month, and either party may end it with thirty days' written notice.

We retain ownership of the ad creative, copy, and campaigns we produce. You grant us a licence to use your clinic name, branding, and any assets you provide for the purpose of running your campaigns. On the end of our engagement, you may continue to run any creative we have made for you on your own account.

You are the controller of any patient or inquirer information that passes through our work for you. We process it on your instructions and for no other purpose.

To run your campaigns we share advertising data with Meta Platforms, and we use tools for call handling, scheduling and record keeping. We will tell you which providers we use before we start, and before we change one.

Inquiries about cosmetic treatments may be treated as health data under the law of some US states, including Washington. You remain responsible for your own obligations to your patients. Where you consider that we handle protected health information on your behalf, we will sign a separate agreement covering it before any such data reaches us.

We limit access to your data to the people who need it, and we will tell you without undue delay if we become aware of a breach affecting it.

Information you give us is processed in the United Kingdom, where ENL Marketing Ltd is established, and is subject to UK data protection law.

At the end of our engagement we will return or delete the personal data we hold for you, at your choice, except where we are required to keep it.

A full data processing agreement is available on request and will be signed before any personal data is shared with us.

To the fullest extent permitted by law, our liability for any claim arising out of our services is limited to the total of the management fees you have paid us in the three months preceding the claim. We are not liable for indirect or consequential losses, or for losses arising from the performance of the advertising platforms themselves.

These terms are governed by the laws of England and Wales, and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the courts of England and Wales. Our clients are located in the United States, and the parties agree to this choice of law notwithstanding that.
